After the publication of Hart's Concept of Law, Dworkin published his article “The Model of Rules,” dividing positivism into two varieties: inclusive and exclusive. Many theorists involved in this debate have characterized Hart's position as inclusivist, which we reject in this article. We argue that Hart, in the postscript to The Concept of Law, conceded a point to Dworkin in accepting that inclusive positivism would imply the existence of objective moral standing, adopting a more “neutral” position—compatible with inclusive and exclusive (...) positivism—and consequently distancing himself from the incorporation thesis, which is paramount to inclusive positivism. Background Q-CEP (Qualificação dos Comitês de Ética em Pesquisa que compõem o Sistema CEP/Conep) is a nationwide project resulting from a partnership between the Brazilian National Research Ethics Commission (Conep), the Ministry of Health and Hospital Moinhos de Vento (HMV). It was developed to consolidate policy for ethical review of research with human beings in all members of the CEP/Conep System, Brazil’s national system of institutional review boards. The aim of this study was therefore to report on the experience and (...) results of the Q-CEP project. Methods An observational, retrospective study includes data from the Q-CEP, obtained from visits to all the institutional research ethics committees (RECs) in the country. The actions implemented by Q-CEP were part of a two-step process: (i) training visits to each REC; (ii) development of distance learning modules on strategic topics pertaining to research ethics evaluation. The data presented herein cover step one (training visits), defined by Q-CEP as the diagnostic stage of the project. For a country with social and economics inequalities such as Brazil, this is a particularly important stage; an accurate picture of reality is needed to inform planning of quality improvement strategies. Results In 2019–2021, Q-CEP visited 832 RECs and trained 11,197 people. This sample covered almost all active RECs in the country; only 4 (0.5%) were not evaluated. Of the 94 items evaluated, 62% did not reach the target of at least 80% compliance and around 1/4 (26%) were below 50% compliance. The diagnostic stage of the process revealed inadequacies on the part of the RECs in their ethical reviews. The analysis of informed consent forms showed compliance in only 131 RECs (15.74%). The description of pending issues made by RECs in their reports was compliant in 19.33% (n = 161). Administrative and operational aspects were also considered inadequate by more than half of the RECs. Conclusions Overall, Brazilian RECs showed poor compliance in several aspects of their operation, both in ethics evaluation and in other processes, which justifies additional training. The Q-CEP project is part of a quality improvement policy promoted by the Brazilian Ministry of Health. The data obtained in the diagnostic step of the project have contributed to the qualification and consolidation of one of the world’s largest research ethics evaluation systems. (shrink)

RESUMO A série Black Mirror, transmitida entre 2011 e 2023 pela Netflix, tornou-se um fenômeno de mídia e seus episódios mostraram formas de interação homem-máquina (terminologia também referida como humano-computador). O nome da série se refere ao fato de que, quando uma tela é desligada, ela se torna um espelho negro que reflete a imagem do usuário. Este artigo1 tem como objetivo analisar os efeitos da interação homem-máquina nas organizações produtivas apresentadas em Black Mirror. Esta pesquisa utilizou a análise do (...) discurso, principalmente a partir das contribuições de Mikhail Bakhtin. O método consistiu em três etapas que contaram com a colaboração de estudantes de graduação e pós-graduação em Engenharia de Produção, integrando ensino e pesquisa e desenvolvendo o senso crítico dos pesquisadores-iniciantes. Os resultados indicam que, nas organizações apresentadas na série Black Mirror, há uma transição do conceito de fatores humanos para fatores ciborgues, bem como o uso da interação homem-máquina para promover o controle social. This article adapts the ethnographic medium of the diary to develop a method for studying data and related data practices. The article focuses on the creation of one data diary, developed iteratively over three years in the context of a national centre for monitoring disasters and natural hazards in Brazil. We describe four points of focus involved in the creation of a data diary – spaces, interfaces, types and situations – before reflecting on the value of this method. We suggest (...) data diaries are able to capture the informal dimension of data-intensive organisations; enable empirical analysis of the specific ways that data intervene in the unfolding of situations; and as a document, data diaries can foster interdisciplinary and inter-expert dialogue by bridging different ways of knowing data. For the epic journey of autumn migration, long-distance migratory birds use innate and learned information and follow strict schedules imposed by genetic and epigenetic mechanisms, the details of which remain largely unknown. In addition, bird migration requires integrated action of different multisensory systems for learning and memory, and the hippocampus appears to be the integration center for this task. In previous studies we found that contrasting long-distance migratory flights differentially affected the morphological complexity of two types of hippocampus astrocytes. Recently, (...) a significant association was found between the latitude of the reproductive site and the size of the ADCYAP1 allele in long distance migratory birds. We tested for correlations between astrocyte morphological complexity, migratory distances, and size of the ADCYAP1 allele in three long-distance migrant species of shorebird and one non-migrant. Significant differences among species were found in the number and morphological complexity of the astrocytes, as well as in the size of the microsatellites of the ADCYAP1 gene. We found significant associations between the size of the ADCYAP1 microsatellites, the migratory distances, and the degree of morphological complexity of the astrocytes. We suggest that associations between astrocyte number and morphological complexity, ADCYAP1 microsatellite size, and migratory behavior may be part of the adaptive response to the migratory process of shorebirds. BackgroundFor a long time, in sports, researchers have tried to understand an expert by comparing them with novices, raising the doubts if the visual search characteristics distinguish experts from novices. Therefore, the aim of the present study was to review and conduct a meta-analysis to evaluate the differences in visual search behavior between experts and novices in team sports athletes.MethodsThis systematic review with meta-analysis followed the PRISMA 2020 and Cochrane's guidelines. Healthy team athletes were included, which engaged in regular practice, (...) from any sex or competitive level, specifically classified a priori as expert or novice in the original research. We considered only research published in peer-reviewed journals, with no limitations regarding date or language. It was considered healthy team sport athletes engaged in regular practice. The scenarios could be in situ or film-based. The databases of EBSCO, PubMed, Scopus, SPORTDiscus, and Web of Science were used to perform the searches. The risk of bias was calculated through the RoBANS tool.ResultsFrom a total of 6,257 records, of which 985 were duplicates, titles and abstracts of 5,272 were screened, and 45 required full-text analysis. Of those, 23 were excluded due to not fulfilling the eligibility criteria regarding participants. In the end, 22 studies were selected, however, as two studies were part of the same trial and were analyzed conjointly.DiscussionExperts showed to be older and with more years of practice. The ability to distinguish experts from novices was not so clear regarding the variables analyzed. This could be due to the strategies chosen in each study, which were specific to each scenario, and when grouping all together, it was lost information within non-representative averages. The distinction between experts and novices was not clear, showing a lot of heterogeneity in the included studies. The expert classification itself may have been the conditioning aspect for these results, retaining the doubt and the need for more studies in the field.Systematic review registrationThe protocol was pre-registered in OSF. The ArgumentJacob de Castro Sarmento was a descendent of New Christians in Portugal who made his way to London in the early eighteenth century. There he professed Judaism openly, but he also advanced his scientific and medical pursuits, becoming particularly enamored of the Newtonian world view. This paper argues that Sarmento's attachment to Judaism was essentially a function of his personal relationship with Hakham David Nieto, and that Sarmento's Judaism was never really the full synthesis of scientific outlook and (...) Jewish theology toward which Nieto pushed him. Rather, after Nieto's death Sarmento identified himself with scientific Newtonianism increasingly openly, while his religious identitly waned. Apparently he found science a more useful outlook in approaching the world, as did many Newtonians of that generation. (shrink)

Él simboliza un marco de referencia en la construcción de un nuevo proceso catequético integral y contextual en las comunidades. La propuesta de Inspiración Catecumenal reaparece en el escenario eclesial como propulsora de la necesidad de renovar el modelo catequético de la Iglesia. El artículo analiza los impactos de la implementación del Catecumenado en las comunidades cristianas del siglo XXI y retrata los testimonios de (...) agentes eclesiales y pastorales. Nesta pesquisa etnográfica, analisamos a intersecção entre práticas de saúde e de segurança pública dirigida aos homens vítimas de conflitos violentos em dois hospitais de trauma no município de Porto Alegre/Brasil. Parte do campo consistiu em acompanhar as narrativas e as interações entre masculinidades criminalizadas e profissionais da segurança pública. Os operadores conceituais centrais são inspirados nos estudos sobre o dispositivo de segurança, Economia moral e no campo das masculinidades e violência. Para homens marcados como sendo do crime, o (...) sofrimento produzido pelo trauma vivido não é apenas invisibilizado; ele é tomado como sinal de periculosidade. Essa dinâmica rege as relações entre masculinidades envolvidas em conflitos violentos e produz o ressentimento como afeto central. (shrink)

The iconoclastic Brazilian anthropologist and theoretician Eduardo Viveiros de Castro, well known in his discipline for helping initiate its “ontological turn,” offers a vision of anthropology as “the practice of the permanent decolonization of thought.” After showing that Amazonian and other Amerindian groups inhabit a radically different conceptual universe than ours—in which nature and culture, human and nonhuman, subject and object are conceived in terms that reverse our own—he presents the case for anthropology as the study of such “other” (...) metaphysical schemes, and as the corresponding critique of the concepts imposed on them by the human sciences. Along the way, he spells out the consequences of this anthropology for thinking in general via a major reassessment of the work of Claude Lévi-Strauss, arguments for the continued relevance of Deleuze and Guattari, dialogues with the work of Philippe Descola, Bruno Latour, and Marilyn Strathern, and inventive treatments of problems of ontology, translation, and transformation. This paper takes the view that compensated donation and altruism are not incompatible. In particular, it holds that the arguments against giving compensation stand on weak rational grounds: the charge that compensation fosters “commodification” has neither been specific enough to account for different types of monetary transactions nor sufficiently grounded in reality to be rationally convincing; although altruism is commendable, organ donors should not be compelled to act purely on the basis of altruistic motivations, especially if there are good reasons (...) to believe that significantly more lives can be saved and enhanced if incentives are put in place, and offering compensation for organs does not necessarily lead to exploitation—on the contrary, it may be regarded as a necessity in efforts to minimise the level of exploitation that already exists in current organ procurement systems. Originally published in 2004 in the Common Knowledge symposium “Talking Peace with Gods,” this article elaborates the nature and consequences of the perspectivist cosmologies of Amerindian societies. Contemporary Western cosmologies regard humans as ex-animals who became differentiated from other nonhuman species through the acquisition of advanced cognitive capacities. Amerindian cultures, by contrast, regard animals as ex-humans who became differentiated from both modern humans and other animal species via a series of physical adaptations. Underneath these physical differences, both humans and nonhumans (...) retain a shared human soul; what is more, each species perceives its own kind as human and all other kinds—including humans—as animals. Viveiros de Castro distinguishes this “perspectivism” from relativism: whereas Western relativism assumes multiple valid cultural models, Amerindian perspectivism holds that human and nonhuman species possess a common values system and cultural framework. While this commonality is ordinarily obscured by biologically grounded, perceptual differences, the gap in perspective may be bridged by shamans, whose gift of adopting nonhuman subjectivities enables them to see other species as they see themselves—namely, as humans partaking in human culture. Perspectivism influences both the practices that Amerindian peoples adopt toward nonhuman species and their attitudes toward other human groups, especially in the context of warfare. The Amerindian warrior’s capacity to overcome an enemy ultimately depends on a shaman-like entry into the subjectivity of another: rather than denying the personhood of his enemy, the Amerindian warrior must acknowledge the affinity between them. RESUMEN La mecánica de Newton fue considerada durante siglos y de manera virtualmente universal como el modelo absoluto del conocimiento científico. Sin embargo, durante el siglo XX, los desarrollos en física suscitaron la necesidad de ampliar el marco conceptual y teórico en torno a aspectos fundamentales como el poder predictivo de los modelos científicos o el rol del observador en la descripción de los fenómenos físicos; esto, a su vez, revitalizó el antiguo debate entre el determinismo y el indeterminismo. En (...) la actualidad, la discusión disciplinaria, lejos de alcanzar un consenso, ha dado lugar a nuevos tipos de preguntas que reflejan un cambio en lo que Cassirer llama el ideal de conocimiento. A partir de una síntesis histórica del debate de las últimas décadas, el presente artículo busca señalar algunas perspectivas contemporáneas del indeterminismo en ciencia. ABSTRACT Newtonian mechanics was for centuries virtually universally regarded as the absolute model of scientific knowledge. However, during the 20th century, developments in physics prompted the need to broaden the conceptual and theoretical framework around fundamental issues such as the predictive power of scientific models or the role of the observer in the description of physical phenomena; this in turn revitalised the long-standing debate between determinism and indeterminism. Today, the disciplinary discussion, far from reaching a consensus, has given rise to new kinds of questions that reflect a change in what Cassirer calls the ideal of knowledge. From a historical synthesis of the debate of the last decades, the present article seeks to point out some contemporary perspectives on indeterminism in science. (shrink)

In this dialogue with Yuk Hui, Eduardo Viveiros de Castro discusses his work on the Amerindian perspectivism, multinaturalism; the relation between nature, culture and technics in his ethnographic studies; as well as the necessity of a non-anthropocentric definition of technology. He also discusses a haunting futurism of ecological crisis and automation of the Anthropocene, and explores a “strategic primitivism” as survival tool.

A patient’s age serves as a very useful guide to physicians in deciding what disease manifestations to anticipate, what treatment to offer for certain conditions, and how to prepare for possible emergencies. In the context of the COVID-19 pandemic, determining treatment options on the basis of a patient’s chronological age can easily give rise to unjustified discrimination. This is of particular significance in situations where the allocation of scarce critical care resources could have a direct impact on who will live (...) and who will die. This paper examines the fairness of recommendations contained in resource allocation guidelines in the Philippines that have implications for the way elderly patients could be treated or excluded from some forms of critical care treatment in the context of the ongoing Corona virus emergency. A proposal to allow prisoners to save their lives or to be eligible for commutation of sentence by donating kidneys for transplantation has been a subject of controversy in the Philippines. Notwithstanding the vulnerabilities associated with imprisonment, there are good reasons for allowing organ donations by prisoners. Under certain conditions, such donations can be very beneficial not only to the recipients but to the prisoners themselves. While protection needs to be given to avoid coercion and exploitation, overprotection has to be (...) avoided. The prohibition on the involvement of prisoners in organ transplantation constitutes unjustified overprotection. Under certain conditions, prisoners can make genuinely independent decisions. When it can be reasonably ascertained that they are able to decide freely, society should recognise an obligation to help them implement their decisions, such as when they intend to donate an organ as a way of asserting their religious faith and performing a sacrifice in atonement for their sins. Despite the unquestionable importance of technological progress in twenty-first-century society, the decision by many political leaders worldwide to treat natural sciences as an almost exclusive priority betrays a terrible misconception of the complexity of the contemporary world. As the Renaissance cannot be reduced to Copernicus’s or Galileo’s brilliant contributions, or Enlightenment to the works of such giants as Newton and Cavendish, contemporary society will hardly be remembered as just a series of amazing software and gadget updates. There are three categories (...) of questions today that only humanities are prone to answer. The first one, exploring the relations between subject and object mediated by the meaning of “property”, ultimately concerns the discussion between legality and legitimacy. Not long ago, teenagers were still being sued by the giants of the Entertainment Industry for downloading songs, and the practice of mash-ups or remixing even now arouses huge polemics. The second one, focused on the self-representations of the subject, concerns the changing meanings (and representations) of identity and cultural borders in a globalizing world. Finally, the inter-subjective interactions are the centre of the political tensions between democracy and demagogy, two opposed categories that have often been presented as hardly distinguishable from each other. The objective of this work is to set out three semantic methods for the analysis of ordinary discourse. These methods arose historically as a solution to certain problems such as those presented by Russell in “On denoting” and which, according to him, all semantic theory should be able to.solve...

Relatively subtle forms of exploitation of human subjects may arise from the inefficiency or incompetence of a researcher, from the existence of a power imbalance between principal and subject, or from the uneven distribution of research risks among various segments of the population. A powerful and knowledgeable person (or institution) may perpetrate the exploitation of an unempowered and ignorant individual even without intending to. There is an ethical burden on the former to protect the interests of the vulnerable. Excessive or (...) insufficient compensation may be exploitative. However, genuine economic imperatives motivating needy volunteers have to be considered. These forms of exploitation should be appreciated in the context of social and cultural factors suggesting that the relationship between researcher and subject cannot properly be appraised as a contractual undertaking. While compliance with pertinent codes and regulations minimises the exploitative potential, they cannot be enforced in a way that does not recognise a society's peculiar characteristics. The experience with some Filipino cultural traits illustrates this point. (shrink)

Disasters and public health emergencies raise a variety of ethical dilemmas, often including those that require balancing the best interests of individuals against those of groups or communities. The on-going COVID-19 pandemic provides examples of these ethical conflicts, as do other recent outbreaks. Decisions and actions in this context must address different ethical issues, ranging from those directly related to autonomy, consent, privacy and confidentiality to those related to interventions and technologies, such as efficacy, effectiveness, safety and fair access. This (...) paper aims to identify ethical conflicts with complex resolutions involving aspects related to values, rights and needs of individuals and the collective, and to suggest how such challenges could lead to more positive experiences and outcomes when confronted in future emergencies. Taking for granted that Marx’s economic theory enjoys a scientific status and, furthermore, that it installed a real Copernican revolution in sociology, the present paper explores the possibility of deriving a system of law deserving the name of “scientific” in so far as it would be in keeping with the theses of the latter scientific theory. In this context, the paper argues against a claim recently sustained by Fernández Liria and Alegre Zahonero, for whom a system of right compatible with (...) Marx’s theory would be compatible, too, with the classic juridical formulations conceived during the Enlightenment. The main reason why this paper testifies against such compatibility is that the enlightened concepts of “equality”, “liberty” and “autonomy” count with the individual as the realm for their juridical application. However, Marx’s subject matter being the social means of production (and not the individuals’ production of value), we conclude that the only juridical subject that could justifiably be derived from his economic investigation would be the “social class”. Finally, the paper suggests that the only way a scientific system of law could grant a juridical status to the individual would be by taking into account the other theory that also installed a Copernican revolution in the social sciences, though this time in the field of psychology: Freud’s psychoanalysis. Careful reading of John Dewey’s The Public and its Problems reveals a weak point at the stage when a given public became self-aware and proceeded to seek representation in the institutions of the state. Aside from a general emphasis on art and science, Dewey’s political theory offered no concrete discussion of the means suitable for this phase of the democratic process. Furthermore, the dichotomy between violence and the peaceful means of art and science left no space for the affirmation of (...) nonviolence – the method most capable of amplifying democracy during the decade following Dewey’s death. Accordingly, the article hypothesizes a novel rendition of nonviolence from the standpoint of Dewey’s understanding of art as social inquiry, compares it with Martin Luther King Jr.’s theory and practice of nonviolent dramatization, and ends by presenting a Deweyan reading of the civil rights movement in terms of the framework contained in The Public and its Problems.
